Terms of Service
These Terms of Service ("Terms") govern your use of commyn.io and the COMMYN app at app.commyn.io (together, the "Service"), operated by COMMYN, Inc. ("COMMYN", "we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
Who can use COMMYN
You must be at least 18 years old to use the Service. By using it, you confirm that you are 18 or older and able to enter into this agreement.
What COMMYN is
COMMYN is a platform where residents share short videos about what living in a building is like. Videos reflect the personal experience and opinion of the person who posted them. COMMYN does not verify every claim made in a video, is not a real estate broker or property manager, and does not guarantee the accuracy, completeness, or availability of any building, unit, price, or amenity shown.
Your content
You own the videos and other content you post. By posting, you give COMMYN a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content on the Service and in COMMYN marketing, for as long as the content remains on the Service. You can delete your content at any time, which ends this license except where the content has already been shared by others or we are required to keep a copy by law.
You are responsible for what you post. By posting, you confirm that:
- The content is your own experience and, to the best of your knowledge, truthful.
- You have the right to share it, including permission from anyone who appears in it.
- It does not violate any lease, confidentiality agreement, or law.
Community rules
Our full Community Guidelines are part of these Terms.
To keep COMMYN useful and safe, do not post content that:
- Is knowingly false or misleading, or is a review of a building you have not lived in or visited.
- Harasses, threatens, or discriminates against any person or group.
- Reveals private information about another person, such as a unit number tied to a named individual, a phone number, or a license plate.
- Contains nudity, sexual content, violence, or illegal activity.
- Is spam, advertising, or content posted in exchange for payment without clear disclosure.
- Infringes anyone's copyright, trademark, or other rights.
We may remove content or suspend accounts that break these rules, at our discretion and without notice.
Buildings and property managers
If you represent a building and believe a video contains false statements of fact or private information, you can report it through the app or by contacting us. We review reports in good faith, but we do not remove content simply because a building disagrees with a resident's opinion.
Copyright complaints
If you believe content on the Service infringes your copyright, send a notice to legal@commyn.com that includes the content location, a description of the work, your contact information, and a statement that you have a good-faith belief the use is not authorized.
Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, COMMYN disclaims all warranties, express or implied, including warranties of accuracy, merchantability, and fitness for a particular purpose. Do not rely on the Service as your only source of information when making a housing decision.
Limitation of liability
To the fullest extent permitted by law, COMMYN and its officers, directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service or any content on it. Our total liability for any claim relating to the Service will not exceed one hundred dollars (USD 100).
Indemnity
You agree to defend and hold harmless COMMYN from claims, damages, and expenses (including reasonable legal fees) arising from content you post or your violation of these Terms.
Termination
You can stop using the Service and delete your account at any time. We may suspend or end your access if you violate these Terms or if we discontinue the Service.
Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Miami-Dade County, Florida.
Changes
We may update these Terms. We will post the new version here with a new effective date. Continued use of the Service after a change means you accept the updated Terms.
